Seablue Swimming Pools warrants to the original residential purchaser, and to the properly registered second owner, for the duration of their ownership, the steel wall panel and wall braces to be free of defects in material and workmanship which would render the structure non-functional. Seablue Swimming Pools agrees to repair or replace, at our option, parts found to be unserviceable according to the following restrictions.
This warranty is subject to the following terms and conditions:
- This warranty is valid provided the Warranty registration is completed within ten (10) days after purchase. There are three ways to register
1) On our web-site at www.seablueswimmingpools.com
2) Complete the attached warranty registration card and Fax it to (985) 892-0667 OR
3) Mail the completed attached warranty registration form to the address provided.
- If the wall panels or wall braces should fail due to manufacturing or material defects, send notification in writing and include photographs to identify the components. We will repair or replace the component at our option within ten (10) days of receipt of the defective component. The defective panel or brace must be shipped freight prepaid and the replacement component will be shipped back freight collect.
- All labor costs for removal and reinstallation of defective wall components and all freight charges shall be paid by the original purchaser or properly registered second owner and will not be reimbursed by "Seablue Swimming Pools".
- This warranty relates only to manufacturing defects and does not include damage or failure resulting from other causes, including but not limited to, acts of God, misuse or abuse, accident, negligence, fire or improper installation.
- Units or assemblies such as pool liner, steps, pool coping, filters, pumps, motors, skimmer, standard fittings, heaters or accessories purchased for use in the pool are subject to and carry only the original manufacturer's warranty.
- In order for you to obtain maximum use and enjoyment from your pool, you should keep your pool full of water at all times. Seablue Swimming Pools is not responsible for any irregularities or imperfections that may result from the removal of water from your pool.
- Total liability to you under this warranty is limited to carrying out the terms of this warranty. No expressed, implied or statutory warranty other than set forth herein is made or authorized to be made by Seablue Swimming Pools.
- Seablue Swimming Pools has no liability to you for damage to panels or braces, which may result from faulty handling or faulty installation by the pool installer.
SEABLUE SWIMMING POOLS SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, BUT NOT LIMITED TO ANY DAMAGES FOR LOSS OF USE OF POOL OR INJURY TO PERSON OR PROPERTY, AND ANY CLAIMS THEREFORE ARE HEREBY SPECIFICALLY DISCLAIMED AND EXCLUDED. SOME STATES DO NOT ALLOW THE EXCLUSION OF OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY, FROM STATE TO STATE.
Seablue Swimming Pools makes no other warranty, express or implied, and any statutory warranties, including implied warranties or MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, are hereby specifically disclaimed and excluded.
No representative of Seablue Swimming Pools nor any of its agents, distributors, or dealers has any authority to alter in any manner the terms of this warranty and Seablue Swimming Pools is not responsible for any undertaking, representation or warranty made by any other person beyond those expressly set forth in this warranty certificate.
